ORDER : The Court made the following order :- The petitioner, apprehending arrest at the hands of the respondent police in connection with the case in Crime No.77 of 2021 for the offence under Sections 174 Cr.P.C. @ 302, 207 IPC @ 147, 148, 120(b), 302 & 201 IPC, has filed this petition seeking anticipatory bail.

2. When the matter is taken up for hearing today, learned Additional Public Prosecutor, on instructions, submitted that this is a second application filed by the petitioner for anticipatory bail. The earlier application filed by the petitioner in Crl.OP(MD) No.6493 of 2021 was dismissed by this Court on 05.05.2021 and suppressing this fact, the petitioner has moved the present application.

CRL OP(MD). No.6711 of 2021 3.Learned Counsel appearing for the petitioner submitted that he was not instructed about the earlier application filed by the petitioner and therefore, sought permission to withdraw the present application.

4. In view of the same, this Criminal Original is dismissed as withdrawn.
