PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, to direct the respondents to disburse the compensation amount of Rs.9,35,371/- along with accrued interest for the portions of properties in Survey Nos.159 and 34/12, Sattambadi Village, Natham Taluk, Dindigul District to the petitioner within a time frame that may be stipulated by this Court. O R D E R

The Writ Petition has been filed to direct the respondents to disburse the compensation amount of Rs.9,35,371/- along with accrued interest for the portions of properties in Survey Nos.159 and 34/12, Sattambadi Village, Natham Taluk, Dindigul District to the petitioner within a time frame that may be stipulated by this Court. 2/7

2. The learned counsel for the petitioner submitted that the respondents have refused to disburse the compensation amount, despite the admitted fact that the petitioner's land had been acquired. It was further submitted that a civil dispute existed among the legal heirs of the land.

3. The respondents contended that the compensation amount had already been deposited in O.S. No. 50 of 2020 on the file of the Additional District Court, Dindigul, and therefore, the petitioner ought to have approached the said Court for disbursement of the amount.

4. However, the learned counsel for the petitioner submitted that the said suit was subsequently withdrawn by the person who had instituted it. When the petitioner approached the Additional District Court, Dindigul, seeking withdrawal of the deposited amount, the Court refused to disburse the same on the ground that the petitioner was not a party to the suit. Further, the petitioner, relying on relevant documents and the 3/7

calculation memo, asserted that her name is Rajakeerthana, daughter of Rajangam, who is the first defendant in the said suit. Therefore, she claims entitlement to the compensation amount. It was further submitted that the petitioner's father had executed a settlement deed dated 01.12.2006, registered as Document No. 2063/2006.

5. Heard the learned Special Government Pleader appearing for the respondents 1, 3 and 4 and the learned counsel appearing for the 2nd respondent.

6. After considering the rival submissions, this Court is of the view that the respondents are not in a position to disburse the amount to the petitioner. It is noted that the petitioner had submitted a cheque application before the concerned Court, which was returned on the ground that the petitioner is not a party to the suit but the petitioner's father was a party. In view of the above, this Court directs the learned Additional District Court, Dindigul, to consider the petitioner's cheque 4/7

application afresh, after issuing notice to the petitioner as well as the rival parties, and to pass appropriate orders within a period of four months from the date of receipt of a copy of this order.

7. With this directions, this Writ Petition is disposed of . No costs.
