consecutively direct the respondents to grant ordinary leave for 30 days without escort to the detenue Palani, S/o.Sangarapandi, aged about 49 years, convict No.4296, PID No.137801 confined at the Central Prison, Palayamkottai.

O R D E R

[Order of the Court was made by N.ANAND VENKATESH, J.] This Writ Petition has been filed challenging the proceedings of the first respondent made in No.1135/Vu.Tha.2/2025, dated 26.02.2026 and for a consequential direction to grant ordinary leave for 30 days without escort to the convict, who is presently confined at Central Prison, Palayamkottai.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing on behalf of the respondents.

3. The petitioner is the brother of the convict. The life convict has served a sentence of 10 years, 6 months and 29 days. An application was submitted by the petitioner seeking ordinary leave and the same has been rejected by the first respondent through the impugned proceedings, dated 26.02.2026 on the ground that the leave was sought for undergoing medical treatment and for settlement of family property and that there were no sufficient materials to substantiate the said grounds. Aggrieved by the same, the present petition has been filed.

4. Taking into consideration the facts and circumstances of the case and the submissions made on either side, this Court is inclined to interfere with the impugned proceedings of the first respondent, dated 26.02.2026 and accordingly, the same is hereby quashed. There shall be a direction to the first respondent to grant 28 days ordinary leave to the convict, subject to the condition that he shall report before the Inspector of Police, Veeravanallur Police Station, daily at 6.00 p.m. during the entire period of ordinary leave. Apart from this condition, the detenue is permitted to submit sureties before the second respondent and two of the sureties shall be family members of the detenue.

5. This Writ Petition (Criminal) is allowed with the above directions. No costs.
