O R D E R

This Writ Petition has been filed to direct the 3rd respondent to consider the petitioner's application/representation dated 05.02.2026 and consequently issue patta in favour of the petitioner in respect of the house plot in Survey No.45/2 (Plot Nos.13 & 14) situated at Udaiyar Nagar, Musiri, Musiri Taluk, Tiruchirappalli District based on the Will dated 30.11.2012 executed by Mrs.K, Parvathi.

2. The learned counsel for the petitioner submitted that the petitioner claims title to the property on the basis of a Will dated 30.11.2012 executed by one Mrs. Parvathi, wife of Kandhan. The said Parvathi and her husband were blessed with two sons and one daughter. Her husband predeceased her on 23.08.2007, leaving behind Parvathi and their three children as his legal heirs. 2/5

Subsequently, Parvathi died on 17.04.2016, leaving behind her two sons, Mr. Rajkumar and Mr. Vasanthakumar. Thereafter, Mr. Vasanthakumar died on 24.04.2021 and Mr. Rajkumar died on 06.10.2025. Both of them died intestate and without any legal heirs. In such circumstances, the petitioner, being the nephew of the said Parvathi, claims rights over the property based on the Will executed by her on 30.11.2012 and has therefore sought issuance of patta in his name.

3. Heard the learned Government Advocate appearing for the respondents.

4. Considering the facts and circumstances of the case, this Court directs the respondents to consider the representation of the petitioner dated 05.02.2026 and pass appropriate orders in accordance with law within a period of 12 weeks from the date of receipt of a copy of this order. 3/5
