Respondents Prayer: Writ Petition filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, to direct the 1st respondent to initiate the suitable action as per G.O(MS)No.540 Revenue (LD6(2) dated 4.12.2014 from stopping and removing the road illegally laid by the 6th respondent over the Vaikal comprised in Sy.No.170 to an extent of 100 metres length and 20 feet width situated in Adhanur Papanasam Taluk, Thanjavur District thereby obstructing the water inflow to the Perumal Kovil Kulam in Sy.No.176 Adhanur Papanasam Taluk Thanjavur District pursuant to the representation dated 4.7.2020 made to the official respondents as per the time frame fixed by this Court and restore the existence of Vaikal to its original position and consequently, maintain the same properly.

ORDER

Heard both sides.

2. The allegation of the petitioner is that the petition mentioned canal was obliterated by the jurisdictional BDO by laying road to favour a private individual. It is admitted that following the filing of this writ petition, the gravel alone had been removed.

3. We direct the respondents to restore the petition mentioned canal to its original condition. This shall be done within a period of four months from the date of receipt of a copy of this order. The Writ Petition is allowed accordingly. No costs. Consequently, connected miscellaneous petition is closed.
