PRAYER: Civil Revision Petition is filed under Article 227 of Constitution of India, to direct the District Munsif cum Judicial Magistrate Court, Thirumayam, to expedite the trial in O.S.No.138/2021, on the file of District Munsif cum Judicial Magistrate Court, Thiurmayam, within the time Stipulated by this Court.

ORDER

The plaintiff in O.S.No.138 of 2021, on the file of the District Munsif cum Judicial Magistrate Court, Thirumaiyam, has filed the present revision petition seeking expeditious disposal of the above said suit. 1/3

2.A perusal of the plaint reveals that the suit has been filed for the relief of permanent injunction as against the adjacent owner of the property. The defendant has already filed his written statement on 14.06.2022, and it is posted for framing of issues from then onwards. In the meantime, it was referred for Mediation.

3.The learned Counsel appearing for the revision petitioner/plaintiff, on instructions, has submitted that his client is not willing to settle the issue before Mediation and wants the matter to be adjudicated by the Court. 4.Considering the above said facts, the trial Court is directed to dispose of the suit on or before 31.12.2025.

5.With the above said observations, this Civil Revision Petition stands disposed of. No costs.
