Respondents PRAYER: Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus, to call for records pertaining to the impugned order passed by the first respondent in Reference No.S1(1)/27000/2015-193, dated 23.09.2015 and quash the same as illegal and arbitrary and consequently direct the Respondent Nos.1 to 3 to allow the petitioner to continue his work as an Assistant Executive Engineer (PWD), Building Construction and Maintenance at Pudukkottai.

2. The petitioner was working as Assistant in Pudukottai. His grievance is that by impugned order dated 23.09.2015, the

fourth respondent herein has been posted in his place without passing any specific order, transferring the petitioner to some other place.

3. Be that as it may, the petitioner has chosen to join in Manamadurai as directed. The petitioner is working at Manamadurai ever since. The petitioner has given representation dated 20.01.2016 to the first respondent, seeking re-transfer to Pudukottai or some other nearby place. The petitioner in his representation had highlighted the domestic circumstances. Considering the facts that the petitioner was working in Manamadurai for more than two years, the first respondent can certainly consider the said representation. The first respondent is directed to pass appropriate orders on the petitioner's representation dated 20.01.2016 within a period of eight weeks, from the date of receipt of a copy of this order.
