O R D E R

This Writ Petition has been filed to direct the respondents No. 2 and 3 to provide necessary police protection to the petitioner's life, limb and construct his house in Survey No. 57/4A situated at Virayathakandan village, Ilaiyangudi Taluk, Sivagangai District. 2.According to the petitioner, he is the owner of the property in Survey No. 57/4A at Virayathakandan village, Ilaiyangudi Taluk, Sivagangai District. While so, after surveying the property, when he tried to construct a house in the said property, the private respondents caused obstruction. Therefore, he sent a representation to the respondent police, but the same has not been considered. Hence, this petition. 3.The learned Additional Public Prosecutor appearing for the respondent Police would submit that they have received the representation of the petitioner and since the dispute is pertains to immovable property, the enquiry is pending with the 2nd respondent. 2/5

However, they will conduct enquiry and dispose the same within a period of 15 days.

4.Considering the prayer of the petitioner, this Court is inclined to dispose of the writ petition without issuing notice to the private respondents.

5.Since the representation of the petitioner is pending with the respondent police, it is appropriate to direct the 2nd respondent to conduct enquiry based on the representation of the petitioner and dispose the same in accordance with law.

6.In view of the same, this Court hereby directs the 2nd respondent to conduct enquiry based on the representation of the petitioner and dispose the same within a period of 15 days from the date of this order, after affording opportunities to both parties in accordance with law.

7.With the above observations and directions, this Writ Petition is disposed of.
