3.J.John Deepan : Respondents PRAYER: Petition is filed under Article 226 of the Constitution of India to issue a Writ of Habeas Corpus, directing the second respondent to secure the detenue, namely, Mrs.Dhanalakshmi, D/o N.Meena aged about 22 years, who is under the illegal custody of the second respondent and the body of the detenue may be produced before this Court and set her at liberty.

*********** [Order of the Court was made by T.S.SIVAGNANAM, J.] Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondents 1 and 2.

2. The petitioner is the mother of the detenu, who is aged about 22 years. The second respondent police have secured the detenu and produced her before us as well as the third respondent, who is alleged to have kidnapped the detenu. The detenu appeared before us and stated that she is married to the third respondent and the marriage was registered on 17.04.2017 and a copy of the https://hcservices.ecourts.gov.in/hcservices/

registration certificate was produced before us. She further stated that she is happy with the third respondent and there is no kidnapping or torture or illegal confinement.

3. Though the matter is listed today, there is no representation on behalf of the petitioner. Though the respondent police have informed the petitioner that they are producing the defence before us today, the petitioner has not appeared before this Court. Further, we spoke to the mother of the third respondent, who, in no uncertain terms, has stated that they hails from a good family and she will take care of her daughter-in-law. Thus, we find that there is no illegal detention of the detenu. Therefore, the Habeas Corpus Petition is dismissed. Sd/- Assistant Registrar(RTI) / True Copy / Sub Assistant Registrar(C.S.)
