This Writ Petition has been filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus, directing the respondents 2 and 3, to immediately provide necessary police protection at the time of laying of the road comprised in Survey No.22/5A and 22/4 E situated at Munandipatti South Area, at Pullaneri Village, Usilampatti Taluk, Madurai District vide proceedings issued by the first respondent in Na.Ka.No.654/2015/Thi 2 dated 24.04.2015. https://hcservices.ecourts.gov.in/hcservices/
2. Mr.R.Sureshkumar, learned counsel appearing for the petitioner would submit that though the Government has sanctioned funds for laying the road comprised in Survey No.22/5A and 22/4E, situated at Munandipatti South Area, at Pullaneri Village, Usilampatti Taluk, Madurai District, vide proceedings issued by the first respondent in Na.Ka.No.654/2015/Thi 2, dated 24.04.2015, some of the encroachers, obstructing the same, therefore, the petitioner has come forward with the aforesaid relief.
3. I have heard the learned counsel appearing on either side and perused the materials available on record.
4. Considering the facts and circumstances of the case and also considering the fact that the property in question is belonged to the Government, the respondents 2 and 3 are directed to provide necessary police protection to lay the road comprised in Survey No.22/5A and 22/4E, situated at Munandipatti South Area, at Pullaneri Village, Usilampatti Taluk, Madurai District. Needless to state that if any encroachers, they may be removed for the purpose of laying the road.
5. With the above direction , the Writ Petition is disposed of. No costs.
