PRAYER :- To release the petitioner/accused on bail in connection with the case in PRC No.46/2014 on the file of the Learned Judicial Magistrate, Pattukottai in Crime No.127/2014 on the file of the respondent Police.

ORDER : The Court made the following order :- The petitioner/Accused, who was arrested and remanded to judicial custody on 13.10.2022 pursuant to the execution of Non Bailable Warrant in Crime No. 127 of 2014 on the file of the respondent police seeks bail.

2. Heard both sides and perused the materials available on record including the First Information Report.

3. It it seen that Non Bailable Warrant was issued in the year 2018 and the petitioner was arrested on 13.10.2022. There are totally six accused in this case and the petitioner herein is arrayed as A1. Further while the petitioner was absconding he involved in another case. The petitioner is a habitual offender and because of the absence of this petitioner the trial is stalled. Though the crime is of the year 2014 because of the absence of the petitioner before the trial Court the trial Court is unable to https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD). No.6616 of 2023 commit the case pending in PRC No.46 of 2014, hence this Court is not inclined to grant bail to the petitioner.
