ORDER
The present revision petition has been filed by third parties to O.S.No.406 of 2008, on the file of the Principal District Munsif Court, Tirunelveli, challenging the dismissal of their application filed under Order 21 Rule 97 (wrongly quoted as Section 47 C.P.C.).
2.A perusal of the records reveal that the application filed under Section 47 of C.P.C. by the third parties to the suit making claim over the property has been dismissed by the executing Court on its merits. Since an appeal remedy is available under Order 21 Rule 103 of C.P.C., the present revision petition is not maintainable.
3.Accordingly, this Civil Revision Petition stands disposed of with liberty to the petitioners to challenge the said order before the competent appellate Court. The petitioner shall file an appeal on or before 30.06.2025. Till such time, the executing Court shall not proceed further. 2/4
4.With the above said observations, this Civil Revision Petition stands disposed of. No costs. Consequently, connected miscellaneous petition is also closed.
