ORDER

The petitioner seeks for quash of the FIR in Crime No.69 of 2024 on the file of the respondent police.

2. The petitioner is the 5th accused in this case. The case of the prosecution is that the respondent police had received a secret information regarding illegal sale of liquor by procuring the same from the government liquor shop. Based on the secret information, the respondent police, while on rounds at about 22.45 hours nearby GK Recreation Club, suspected a Maruti Celerio car bearing registration No.TN 01 AX 3313.

3. On enquiry, the accused 1 to 4, who were in the said car, were found to have been in possession of liquor bottles and six boxes containing 191 bottles of Golden Eagle Doctor Brandy liquor. It was also found that they had purchased the liquors from the Tasmac shop No.11819 and were selling the same to GK Recreation Club at a higher price. For procuring the same from Tasmac, they were paying commission to the supervisor and salesman of the Tasmac. Hence, the case.

4. Heard the learned counsel on either side and perused the materials placed before this Court.

5. The accused were caught red-handed and specific overtacts have been attributed against them and hence, I do not find any merit in interfering with the FIR. In view of the same, this criminal original petition fails and the same is dismissed.
