: Respondents PRAYER: Petition is filed under Section 482 of the Criminal Procedure Code, to direct the second respondent to register a case against the respondents 3 to 7 on the complaint made by the petitioner dated 25.04.2018.

ORDER

The prayer sought for herein is to direct the second respondent to register a case against the respondents 3 to 7 on the complaint made by the petitioner dated 25.04.2018. 2.According to the petitioner, the matter is sub judiced before the Civil Court. In the mean time, the proposed accused persons have interfered with the subject matter of the property. Therefore, the petitioner made a complaint before the respondent police. But, no action has been taken, hence, the present Criminal Original Petition has been filed.

3.The learned Additional Public Prosecutor appearing for the respondents 1 and 2 would submit that enquiry has been conducted. During the enquiry, the petitioner himself has requested that he can https://hcservices.ecourts.gov.in/hcservices/

approach the Civil Court to seek his remedy. Therefore, recording the same, the complaint was closed. The copy of the closure report has also been placed before this Court.

4.Recording the submission made by the learned Additional Public Prosecutor and taking the closure report on file, this Criminal Original Petition is dismissed. However, it is for the petitioner to work out his remedy before the appropriate forum.
