PRAYER: Criminal Original Petition is filed under Section 528 of BNSS, 2023, directing the second respondent not to harass the above named petitioners in the guise of enquiry and pass any other orders. ORDER

The present Criminal Original Petition has been filed seeking a direction as against the second respondent police not to harass the petitioners under the guise of enquiry.

2. It could be seen from the records that the first petitioner's husband is an accused in POCSO case and he is absconding. In order to ascertain the whereabouts of the first petitioner's husband, the second respondent police authorities are said to have called upon the petitioners herein for an enquiry and therefore, the present petition has been filed.

3. Considering the above said facts, there shall be a direction to the second respondent police, to restrict their enquiry with regard to the 2/5

residential premises of the first petitioner and should not visit the place where the petitioners are working or studying. The said enquiry shall be completed within a period of two weeks.
