Respondents Prayer: Writ petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the second respondent to release the petitioner's vehicle of Tipper Lorry, bearing Registration No.TN 22 BY 1685 from his custody and to hand over the above vehicle to the petitioner by considering the petitioner's representation dated 27.07.2020 within the time limit that may be stipulated by this Court.

Heard the learned counsel on either side.

2.The petitioner seeks release of the petition mentioned vehicle.

3.The learned Government Advocate points out that the petition mentioned vehicle was involved in a previous case of the same nature.

4.Therefore, I am not inclined to show indulgence. However, the respondents cannot retain the vehicle in their station premises https://hcservices.ecourts.gov.in/hcservices/ 1/4

2 W.P.(MD)No.8692 of 2020 indefinitely. This is because, the value of the vehicle will be lost. Therefore, the second respondent is directed to produce the vehicle before the jurisdictional Court without any delay. The petitioner is at liberty to move the jurisdictional Court for release of the petition mentioned vehicle. The jurisdictional Court will dispose of the petition for interim custody within a period of two weeks from the date of receipt of a copy of this order. 5.With this direction, the Writ Petition stands dismissed. No costs.
