PRAYER :- For bail in Cr.No.223/2021 on the file of the respondent police ORDER : The Court made the following order :- The petitioners, who were arrested and remanded to judicial custody on 24.04.2021 for the offences punishable under Sections 147, 364A, 506(ii) IPC in crime No.223 of 2021 on the file of the respondent police, seek bail.

2.The case of the prosecution is that on 23.04.2021, there was compromise talk between on Sethu Parvathi Bai and the defacto complainant's brother-in-law, pertaining to vacate the shops, wherein the defacto complainant's brother-in-law was doing business. As per the compromise, the said Sethu Parvathi Bai, paid Rs.13,50,000/- to the brother-in-law of the defacto complainant and o ne Dharbar Ravi also participated in the compromise and the accused persons also present. In order to compromise the dispute, the brother-in-law of the defacto complainant agreed to pay Rs.2 Lakhs to the first petitioner herein. After paying the said amount, the first petitioner demanded additional sum of Rs.50,000/- and when the defacto complainant's brother-in-law refused the same, the accused taken away the him in a car and demanded Rs.1 Lakh and threatened them. Hence, the complaint.

CRL OP(MD)No.6828 of 2021 3.The learned counsel for the petitioners seeks permission of this Court to withdraw this petition, as far as the first petitioner is concerned. He would further submit that the second petitioner is an innocent and he is in judicial custody from 24.04.2021 and hence, he may be granted bail.

4.The learned Government Advocate(Crl.Side) appearing for the respondent police would submit that the petitioners are having several cases in various Districts i.e., Tirunelveli, Thenkasi, Erode, Thoothukudi and it is a sensational case in Nagercoil City. Hence, he strongly opposed to grant bail to the petitioner. 5.In view of the submission of the learned counsel for the petitioners, this criminal original petition is dismissed as withdrawn, as far as the first petitioner is concerned. Considering the bad antecedents of the second petitioner, this Court is not inclined to grant bail to the second petitioner. Accordingly, this criminal original petition is dismissed as far as the second petitioner is concerned.
