PRAYER :- For Bail in Crime No.49/2021 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner/sole accused, who was arrested on 30.04.2021 for the offences punishable under Sections 379 of IPC r/w.21(5) of Mines and Minerals Development and Regulation Act, 1957 in Crime No.49 of 2021 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner herein tried to load sand from the Parapathu Odai on 29.04.2021 in the early hours at about 01.15 hrs in a Tractor bearing Reg. No. TN 19 X 4340. On seeing the police he left the tractor and other equipments and escaped from the scene of occurrence. Thereafter the case came to be registered.

3. The learned counsel for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case. He would further submit that due to pandemic situation he was granted interim bail by this Court 20.05.2021. https://hcservices.ecourts.gov.in/hcservices/

4. The learned Additional Public Prosecutor opposed the bail petition on the ground that four previous cases of similar nature are pending against him.

5. Taking note of the facts and circumstances of the case and also the fact that four previous cases of similar nature are pending against the petitioner, this Court is not inclined to grant bail to the petitioner.

6. Hence the petition stands dismissed.
