ORDER
The learned counsel for the petitioner states that the petitioner has an independent right over the property by virtue of the allotment made in the final decree passed in O.S.No.55 of 1950. If that were to be the case, then it is for the third party, civil revision petitioner, to file an independent suit for declaration of title and for consequential reliefs. Accordingly, the learned counsel for the petitioner seeks permission of this Court to withdraw this revision to file an independent suit. He has also made an endorsement to that effect in the case bundle.
2.In view of the endorsement made by the learned counsel for the petitioner, this Civil Revision Petition is dismissed as withdrawn. The learned trial Judge has already granted the liberty in paragraph No.10 of the order. The said liberty is confirmed.
No costs. Consequently, connected Miscellaneous Petition is closed. 02.06.2026 NCC :
