O R D E R

This Criminal Original Petition has been filed to quash the First Information Report in Crime No.73 of 2020 on the file of the Keelavalavu Police Station, Madurai District

2. When the matter is taken up for hearing today, the learned Additional Public Prosecutor appearing for the first respondent submitted that based on the complaint given by the second respondent, the first respondent registered First Information Report in Crime No.73 of 2020 and thereafter investigated the same. After investigation they closed the First Information Report as' Mistake of Fact' on 08.06.2021.

3. The learned counsel appearing for the petitioner also present before this Court.

4. The learned counsel appearing for the second respondent contended that he has not received any notice from the first respondent.

5. In view of the above submissions and considering that already the case was closed as Mistake of Fact, this Court need not pass any further orders in this matter. If the second respondent aggrieved by the said closure report she can approach the concerned Judicial Magistrate by way of protest petition according to law. 2/4

6. With the above observation, this Criminal Original Petition is disposed of. Consequently connected miscellaneous petition is also closed.
