COMMON PRAYER:- Petitions filed under Section 482 of the Code of Criminal Procedure, to modify the condition No.1 of the bail orders, dated 30.04.2021, 05.05.2021 imposed upon the petitioners by the Principal District and Sessions Judge, Pudukottai in Cr.M.P.No.1711 of 2021 and Cr.M.P.No.1795 of 2021, respectively.
COMMON ORDER The present petitions have been filed to modify the condition No.1 of the bail orders, dated 30.04.2021, 05.05.2021 imposed upon the petitioners by the Principal District and Sessions Judge, Pudukottai in Cr.M.P.No.1711 of 2021 and Cr.M.P.No.1795 of 2021, respectively.
2.The learned counsel for the petitioners submits that the petitioners are only mechanics and due to pandemic situation, they do not have enough business. In the crucial financial circumstances, they are not in a position to collect such a huge amount, as ordered by the lower Court. Therefore, he prays for modification of the condition No.1 of the bail orders.
3.Considering the facts and circumstances of the cases and the present pandemic situation, Crl.O.P.(MD)No.6826 of 2021 is allowed modifying the condition No.1 of the order of the Principal District and Sessions Judge, Pudukottai in Cr.M.P.No.1711 of 2021 as "the petitioners shall jointly deposit a sum of Rs.50,000/- (Rupees Fifty Thousand only), in the name of the District Collector, Pudukkottai District (COVID-19) Indian Overseas Bank, Pudukkottai Branch, Code NO.0072, Bank A/c.No.007201000064822, IFSC Code:IOBA0000072. It will be a non-refundable payment."
4.Also, Crl.O.P.(MD)No.6830 of 2021 is allowed modifying the condition No.1 of the order of the Principal District and Sessions Judge, Pudukottai in Cr.M.P.No.1795 of 2021 as "the petitioners shall jointly deposit a sum of Rs.50,000/- (Rupees Fifty Thousand only), in the name of the District Collector, Pudukkottai District (COVID-19) Indian Overseas Bank, Pudukkottai Branch, Code NO.0072, Bank A/c.No.007201000064822, IFSC Code:IOBA0000072. It will be a non-refundable payment."
