ORDER : The Court Made the following order :- The petitioner, who apprehended arrest at the hands of the respondent Police for the alleged offence punishable under Section 379 I.P.C., in Crime No.67 of 2016, on the file of the respondent Police, seeks anticipatory bail.

2. Heard Mr.C.Vakeeswaran, learned counsel appearing for the petitioner / accused and Mr.A.P.Balasubramani, learned Government Advocate (Criminal Side) appearing for the State.

3. It is seen that initially, the petitioner / accused was granted bail by the learned Judicial Magistrate No.I, Trichy, vide Order dated 25.01.2016, in Crl.M.P.No.233 of 2016. Since he did not comply with the bail conditions, the respondent Police filed C.M.P.No.848 of 2016 for cancelling the bail, pursuant to which the Trial Court has cancelled the bail granted to the petitioner / accused on 10.03.2016. Under such circumstances, it is not open to the petitioner / accused to file application for anticipatory bail.

4. Accordingly, this criminal original petition fails and it is dismissed with liberty to the petitioner / accused to challenge the Order, dated 10.03.2016, passed in C.M.P.No.848 of 2016, by the learned Judicial Magistrate No.I, Trichy, in accordance with law. sd/- 31/03/2016 / TRUE COPY / Sub-Assistant Registrar (C.S.)
