PRAYER :- For Bail in Crime No.1388 of 2020, C,C.120/2021 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioners, who were arrested on 23.05.2021 for the offences punishable under Sections 8(c) r/w 20(b) (ii)(C) and 29(1) NDPS Act in Crime No.1388 of 2020 on the file of the respondent police, seek bail.

2.The case of the prosecution is that 05.09.2020 at about 03.00 pm., when the respondent police on their regular patrol at Anaiyur, near Imayam Nagar, first accused was found along with a white gunny bag and more than 15 persons. Police nabbed the first accused and the petitioners. The gunny bag contained 22kg of ganja. Hence, the present case has been registered.

3.The learned counsel for the petitioners would submit that the petitioners are innocent and they have been falsely implicated in this case. He would further submit that the petitioners are in custody from 23.05.2021 and hence, he seeks bail for the petitioners.

CRL OP(MD)No.7402 of 2021 4.The learned Government Advocate(Crl.Side) appearing for the respondent opposed this petition on the ground that the petitioners and other accused were in illegal possession of 22kg of ganja. 5.This is second bail petition. Earlier bail petition dismissed by this Court only on 30.04.2021, by considering all the points raised by either side. There is no change in circumstances in this case to entertain this petition. Hence, this Court is not inclined to grant bail to the petitioner. Accordingly, this criminal original petition is dismissed.
