For Respondent : Mr.S.Ravi, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :-For anticipatory bail in Crime.No. 183/2021 on the file of the respondent police ORDER : The Court made the following order :- The petitioners apprehending arrest at the hands of the respondent police for the offences punishable under sections 403, 406 and 420 of I.P.C., in Crime No.183 of 2021, on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that due to money dispute between the petitioners and the de facto complainant herein, the present case has been registered against them.

3. The learned counsel appearing for the petitioners would submit that the petitioners are innocent persons and they have not committed any offence as alleged by the prosecution and they have been falsely implicated in the present case and hence, they seek anticipatory bail.

4. The learned Additional Public Prosecutor appearing for the respondent Police would submit that even though there is an agreement between the de facto complainant and the petitioners, the petitioners along with several persons have cheated the de facto complainant to the tune of Rs.30,00,000/-. He would further submit that custodial interrogation is required in this case and hence, he vehemently opposed the grant of anticipatory bail to the petitioners. He would further submit that the first and second accused were arrested and remanded to judicial custody.

5. Since the custodial interrogation is required in this case, at this stage, this Court is not inclined to grant anticipatory bail to the petitioners herein.

6. With the above observations, the Criminal Original Petition stands dismissed.
