Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of MANDAMUS, directing the 1st respondent to cancel and withdraw the property tax assessment made in respect of House Door No.5, Edatheru, Thirunageshwaram, Kumbakonam Taluk, bearing Assessment No.5772, which stands in the name of the 3rd respondent, as being illegal, arbitrary and without

authority of law, consequently directing the 2nd respondent to disconnect the electricity service connection granted to the 3rd respondent solely on the basis of the said Assessment No.5772 on the file of the 1st respondent and pass such further orders as this Honble Court may deem fit and proper in the circumstances of this case and thus render justice.

ORDER

The writ petition is filed with a direction to the 1st first respondent to cancel and withdraw the property tax assessment made in respect of house Door No.5, Edatheru, Thirunageshwaram, Kumbakonam Taluk, bearing Assessment No.5772, which stands in the name of the 3rd respondent.

Heard Mr.S.Balamurugan, learned counsel appearing for the petitioner, Mr.T.Amjad Khan, learned Government Advocate, who takes notice on behalf of the 1st respondent and Mr.M.Viji for Mr.K.Nagarajan, learned counsel, who takes notice on behalf of the 2nd respondent. 3.The writ petition is disposed of at the admission stage itself, without issuing notice to the 3rd respondent. In view of the limited relief granted, this Court has not expressed any opinion on the merits of the allegations made by the petitioner .

4. Since it is submitted by the learned counsel on either side that the petitioner has submitted a representation and that an enquiry is being conducted by the 1st respondent, the enquiry shall be completed by providing an opportunity to the petitioner, the 3rd respondent, and other interested parties, and final orders shall be passed in the manner known to law.

5. The writ petition stands disposed of with a direction to the 1st respondent to complete the enquiry and pass final orders, after due notice to the petitioner, the 3rd respondent, and any other interested parties, if any, as expeditiously as possible, and in any event, not later than eight weeks from the date of receipt of a web copy of this order, without waiting for the certified copy.
