This Writ Petition has been filed under Article 226 of the Constitution of India praying for a Writ of Mandamus, directing the respondent to consider his application for new electric service connection in S.F.No.567-B in Pavithiram Village of Aravakurichi Taluka, Karur District, in view of the fact that he was already given connection namely SC 310 for agricultural purpose, for the hut owned by petitioner herein within such time as may be specified by this Court.

ORDER

This Writ Petition has been filed praying for a Writ of Mandamus, directing the respondent to consider his application for new electric service connection S.F.No.567-B in Pavithiram Village of Aravakurichi Taluka, Karur District, in view of the fact that he was already given connection namely SC 310 for agricultural purpose, for the hut owned by petitioner herein within such time as may be specified by this Court.

2. Mr.S.M.S.Johnny Basha, learned counsel takes notice for the respondents.

3. By consent, the Writ Petition itself is taken up for final disposal.

4.Though very many contentions have been raised in the Writ Petition, at the time of making submissions, the learned counsel for the petitioner submitted that if a direction is given to the https://hcservices.ecourts.gov.in/hcservices/

respondent to consider the representation of the petitioner, dated 08.10.2015, that would be suffice.

5. In view of the same, without going into merits of the claim made by the petitioner, this Court directs the respondent to consider the representation of the petitioner, dated 08.10.2015, and pass orders on merits and in accordance with law, by affording an opportunity of hearing to the petitioner, within a period of three weeks from the date of receipt of a copy of this order. It is made clear that this Court has not expressed any opinion on the merits of the claim made by the petitioner and it is for the respondent to consider the same purely on merits. With the above direction, the Writ Petition is disposed of. No Costs.
