For Respondent : Mr.M.Muthumanikkam, Government Advocate (Criminal Side) PETITION FOR ANTICIPATORY BAIL Under Section 438 of Cr.P.C PRAYER :- For Anticipatory bail in Crime No.348 of 2021 on the file of the respondent police.
ORDER : The Court made the following order :- The petitioner/Sole accused, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 307,323,324 of IPC r/w. Section 4 of TNPHW Act, in Crime No.348 of 2021, seeks anticipatory bail.
2.The case of the prosecution is that there is a previous enmity between the defacto complainant and the accused in connection with eve teasing her daughter. On 14.05.2021 at about 9.00 pm., when the defacto complainant's mother was standing infront of the house the accused came and attacked her with iron rod on her head, as a result she sustained fracture and injuries on her head. Therefore, this case came to be registered.

CRL OP(MD). No.6885 of 2021 3.The learned counsel for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case.
4.The learned Government Advocate (Criminal side) for the respondent strongly opposed this petition on the ground that investigation is pending.
5.It is seen from the allegations made in the complaint that the defacto complainant was attacked by iron rod and she suffered injured suffered fracture in her hand and injuries on her head. The First Information Report was registered on 15.05.2021 and the investigation is at the preliminary stage. Therefore this Court is not inclined to grant anticipatory bail to the petitioner.
