BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT ( Criminal Jurisdiction ) Monday, the Seventeenth day of December Two Thousand Eighteen PRESENT The Hon`ble Mr.Justice M.NIRMAL KUMAR CRL OP(MD) No.18980 of 2018 DEVAKI ... PETITIONER / ACCUSED NO.2 Vs STATE REP.BY THE INSPECTOR OF POLICE Y.OTHAKADAI POLICE STATION, MADURAI DISTRICT.

CRIME NO.332/2018 ... RESPONDENT / COMPLAINANT For Petitioner : Mr.S.KRISHNAN, Advocate For Respondent : Mr.S.CHANDRASEKAR, Additional Public prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8(c), 20(b) (ii) (B) of NDPS Act in Crime No.332 of 2018, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner is said to have supplied ganja to A-1 for selling purpose. 3.The learned counsel for the petitioner would submit that the petitioner is arrayed as A-2 in this case. A-1 was found in possession of 1250 grams of ganja and the petitioner has been arrayed as an accused based on the confession of A-1. Admittedly, the petitioner is the mother-in-law of A-1 and due to some family dispute, she has been falsely implicated in this case.

4. The learned Additional Public Prosecutor filed a counteraffidavit, wherein he detailed about the previous cases pending against the petitioner.

5. Considering the gravity of offence said to have been committed by the petitioner and considering the bad antecedent of

the petitioner, this Court is of the view that the petitioner is not entitled for anticipatory bail. Hence, this Criminal Original Petition is dismissed.
