Respondents Prayer: Writ petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the respondents by cancelling the old patta and to issue new patta in S.No.499/4 to an extent of 3-1/4 cents by considering the petitioner's representation dated 02.04.2022 within the stipulated time that may be fixed by this Court.

O R D E R

Heard the learned counsel appearing for the writ petitioner and the learned Special Government Pleader appearing for the respondents.

2. The petitioner had purchased the petition mentioned land from one Ramasamy Naicker under sale deed dated 03.09.2010. The said Ramasamy Naicker had in turn purchased the same from one Thulasi Ammal and her legal heirs under sale deed dated 29.08.1977. Both are registered documents. Based on the purchase made by her, the petitioner approached the respondents for issuance of patta in her name. Instead of issuing proper patta, the second respondent issued free house site patta in favour of the petitioner on 19.08.2019. The petitioner sent a representation on 02.04.2022 seeking cancellation of the free house site patta and issuance of proper patta in her name.

3. No exception can be taken to her request. The second respondent is directed to cancel the free house site patta issued in favour of the petitioner and to issue new proper patta in her name. This shall be done within a period of six weeks from the date of receipt of a copy of this order.
