Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- Apprehending arrest at the hands of the respondent police in S.C.No.117 of 2011, on the file of the respondent police for offences under Sections 392, 397 and 506(ii) IPC, the petitioner is now before this Court seeking Anticipatory Bail. 2.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) for the respondent. 3.When the case was taken up for hearing, the learned counsel for the petitioner submitted that the petitioner was absent only on 19.02.2016, on which date, non bailable warrant was issued, whereas, the learned Government Advocate (Crl.
Side) submitted that non bailable warrant is pending from 20.02.2014. Since there is a dispute with regard to these facts, this petition is dismissed with a direction to the petitioner to approach the Additional Sessions Judge, Sivakasi, and file an application for anticipatory bail in S.C.No.117 of 2011 and if the same is dismissed, liberty is given to the petitioner to approach this Court. Because, only then, this Court will know the correct facts from the order of the Court below. In the absence of the order of the Court below, this Court is indeed handicapped.
