PETITION FOR BAIL Under Sec.483 of BNSS PRAYER :- For Bail in Crime No. 75 of 2025 on the file of the respondent-police. ORDER : The Court made the following order :- This Criminal Original Petition has been filed by the petitioners on 27.03.2025 under Section 483 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, praying to grant bail.

2. The petitioners / Accused Nos.1 to 3 were arrested and remanded to judicial custody on 10.03.2025, for the offence punishable under Sections 296(b), 118 (1), 109(1) and 351(3) of BNS, 2023, in Crime No.75 of 2025, on the file of the respondent-Police.

3. The case of the prosecution is that the first petitioner demanded back the amount from the defacto complainant, which he borrowed from one Chinniah. Hence, the defacto complainant questioned his right to demand the said amount and he refused to pay the said amount to the petitioner. Due to such motive, on 09.03.2025, at about 03.00 p.m., the petitioners abused the defacto complainant in filthy language and also assaulted him with stones thereby causing bleeding injuries. They also threatened the defacto complainant with dire consequences. 2/5

Hence, the complaint.

4. Mr.D.Rameshkumar, learned counsel for the petitioners, submits that the petitioners have nothing to do with the alleged offence and they have been falsely implicated in this case. He further submits that the petitioners have been in judicial custody since 10.03.2025 and they are ready to abide by any stringent conditions that may be imposed by this Court. Therefore, he prays for granting bail to the petitioners.

5. Per contra, Mr.K.Sanjai Gandhi, learned Government Advocate (Crl. Side) appearing for the respondent-police, submits that the first petitioner is having three previous cases and the petitioners 2 and 3 are having one previous case each. He further submits that the investigation is not yet completed. He contends that, if the petitioner is released on bail, he may cause threat to the defacto complainant. Hence, he prays for dismissal of this petition.

6. Heard on both sides. This Court has perused the records.

7. Considering the facts and circumstances of the case and considering the bad 3/5

antecedents of the petitioners and taking note of the fact that if bail is granted to the petitioners, he may cause threat to the defacto complainant and witnesses, this Court is not inclined to grant bail to the petitioners.
