ORDER

Seeking transfer of investigation from the file of the 3rd respondent police to the competent authority viz., 2nd respondent herein this petition has been filed on the ground that no progress has been made in the complaint given by the petitioner registered in Crime No.74 of 2023.

2. The learned Additional Public Prosecutor would submit that the case has been registered recently and the investigation is under progress.

3. The learned Senior counsel appearing for the accused Nos. 3 and 4 submitted that the complaint has been given by the defacto complainant only to collect the money from accused Nos.3 and 4, since they are land promoters. The allegation has been made that the amount has been transferred to account of the first accused, for which, the accused Nos. 3 and 4 cannot be held as responsible.

4. Since the enquiry is in pre-matured stage, there is no necessity for transferring the investigation. Let the above investigation be monitored by the 2nd respondent herein.

5. With the above direction, this Criminal Original Petition is dismissed. Consequently, the connected Miscellaneous Petition is closed. 19.06.2023 NCC :
