RESPONDENT / COMPLAINANT Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to recall the order and cancel the Anticipatory Bail granted to the respondents 1 and 2 by order dated 03/04/2018 in Crl.O.P.(MD) NO.3913 of 2018 and thus render justice.
Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.S.SUNDARAPANDIAN, Advocate for the petitioner and of Mr.T.LAJAPATHI ROAY, Advocate for R1 & R2, and Mr.A.ROBINSON, Government Advocate(Crl.Side) on behalf of the Respondent, the court made the following order:- This Court had granted anticipatory bail to the accused in Crime No.01 of 2018 registered in AWPS, Uthamapalayam, Theni District. The husband of the petitioner herein had given an undertaking that the he will remit a sum of Rs.5,000/- per month to the petitioner.
2.But, complaining that this condition has been breached, this application for cancellation for anticipatory bail has been filed. 3.When the matter is taken up today, the learned counsel for the accused produced a demand draft for a sum of Rs.15,000/-. 4.The learned counsel for the petitioner herein shall file a memo to the registry by today (i.e., 02.07.2018) setting out the bank details after serving a copy of the same to the learned counsel for the accused. From next month onwards, the accused shall remit such sum without any default straight away in the bank account of his wife.
5.Recording the above, this Criminal Miscellaneous Petition is dismissed.
