PRAYER: Criminal Original Petition is filed under Section 482 of Cr.P.C, directing the respondents 2 to 4 police not to harass the petitioners on the guise of enquiry on the basis of the complaint lodged by the 5th respondent.

For petitioners : Mr.J.Karmega Kannan For R-1 to R-4 : Mr.S.Manikandan, Government Advocate (Criminal Side) O RDER This petition has been filed seeking for a direction to respondent Nos.2 to 4 Police not to harass the petitioners on the guise of enquiry on the basis of the complaint lodged by the fifth respondent.

2. The case of the petitioners is that the petitioners are running a jewellery shop. The petitioners borrowed a sum of Rs.60,00,000/- from the fifth respondent for their business development. The petitioners also gave cheque and pronotes to the fifth respondent for security purpose and they paid the interest amount regularly. But the fifth respondent demanded more exorbitant interest in order to grab their property. On 12.03.2022, the fifth respondent lodged a complaint before the respondent Police against the petitioners on the ground that the petitioners have cheated the fifth respondent. The petitioners also appeared before the second respondent for enquiry and submitted his reply. But without considering the same, the second respondent has repeatedly harassed the petitioners. Hence, the petitioner filed this 2/4

petition before this Court to give a direction to the respondent Police to not to harass the petitioner on the guise of enquiry.

3. When the matter was taken up for hearing, the learned Additional Public Prosecutor appearing for the respondent Police would submit that the enquiry has been conducted and closed on the complaint given by the fifth respondent.

4. In view of the above, no further orders are required to be passed in this Criminal Original Petition and the same stands dismissed Liberty is granted to the petitioners to work out their remedy in the manner known to law.
