Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the respondent herein to dispose of the petitioner's appeal dated 16.03.2020 on merits in accordance with law and to modify the property tax, solid waste and management tax to the petitioner's shops in Door No.446B and 446J in Tenkasi Road, Rajapalayam Town within the time stipulated by this Court.

ORDER

The petitioner owns shops in Door Nos.446B and 446J in Rajapalayam Municipality. Both the shops are commercial properties. The extent of the shop in Door No.446B is 128 square feet and the extent of the shop in Door No.446J is 96 square feet. The petitioner's property is adjacent to his relatives' property, which are all similar in nature with regard to extent. The property tax for the shop in Door No.446B is Rs.7576/- along with solid waste management charges of Rs.1440/-. On the other hand, the shops of the petitioner's relatives, which are adjacent to the petitioner's property, are charged with much lesser tax and charges. Hence, the petitioner aggrieved against the order of the respondent had filed an appeal on 16.03.2020 and thereafter, no action has been taken. The petitioner's appeal has been kept without any discussion. Hence, the present Writ Petition has been filed.

2. Learned Standing Counsel for the respondent submits that the petitioner's appeal can be disposed of within a stipulated time and further submits that within a period of eight (8) weeks, the entire appeal would be disposed of.

3. Considering the above submission made by the learned Standing Counsel for the respondent, this Court directs the respondent to dispose of the petitioner's appeal within a period of eight (8) weeks from the date of receipt of a copy of this order. The appeal may be placed before the Taxation Appeal Committee of Rajapalayam Municipality.

4. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
