For Respondent : Mr.S.Ravi, Additional Public Prosecutor PETITION FOR BAIL Under Sec.439 of Cr.P.C PRAYER :- For Bail in Crime No.90/2021 on the file of the respondent police.

ORDER : The Court made the following order :- When the matter was listed on 19.05.2021, this Court allowed the petition and in the evening time, one Mr.Purantharadhas appeared through video conferencing and submitted that he has already filed an application seeking bail in Crl.O.P.(MD)SR.No.12478 of 2021. But that application was kept pending by the Registry. Suppressing the same, this petition has been filed by another advocate and it is also numbered and listed and oral order was also passed. But then, Registry was directed to list the matter under the caption 'for clarification' on 20.05.2021.

2.It is seen that Crl.O.P.(MD)No.12478 of 2021 has been filed setting out the fact that it is the second bail application. Since the earlier bail application was dismissed as withdrawn and the fact was not mentioned in this petition, so this trouble arose. https://hcservices.ecourts.gov.in/hcservices/

3.However, the learned counsel for the petitioner submitted that he was not informed by the petitioner about the engagement of Mr.Purantharadhas and filing of the above said petition. 4.Considering the facts and circumstances of the case and in view of the submission made by the learned counsel for the petitioner that he wants to withdraw this petition, earlier order dated 19.05.2021 is recalled and this Criminal Original Petition is dismissed as withdrawn.

5.Registry is directed to process with Crl.O.P.(MD)SR.No.12478 of 2021 as per the procedure.
