To call for the records relating to the Judgement and Decree dated 24.04.2009 in A.S.No.545 of 2004 on the file of the Principal Subordinate Judge, Dindigul confirming the judgement and decree dated 27.07.2004 in O.S.No.272 of 2000 on the file of the 2nd Additional District Munsif and set aside the same and allow this second appeal.

CMP(MD) No.7536 of 2022 the 1st Respondent and of MR.M.R.SREENIVASAN, Advocate on behalf of the Respondent Nos.2 & 5 and MR.M.SARAVANAN, Advocate on behalf of the 6th Respondent and none appeared either in person or by an Advocate on behalf of the Respondent Nos.3,4,7, the court made the following order:- This petition is filed to exempt the appellants from bringing on record the legal representatives of respondents 8 and 9 in the second appeal.

2.Heard the learned counsel for the petitioner, the learned counsel for the 1st respondent, the learned counsel for respondents 2 and 5 and the learned counsel for the 6th respondent. 3.Respondents 8 and 9 are the LRs of the deceased 8th defendant, who remained ex-parte before the first appellate Court. Hence, this petition is allowed.
