Respondents Prayer in Habeas Corpus Petition(MD) No. 598 of 2019 : Habeas Corpus Petition is filed under Article 226 of the Constitution of India Praying that the High Court will be pleased to issue a Writ of Habeas Corpus directing the 1 and 2 Respondents to produce the petitioner's minor daughter namely Narthana Nayanai, D/o. Malarvannan aged 07 years and to hand over the custody of the Petitioner's daughter to the petitioner.

ORDER:- Habeas Corpus Petition is coming upon for hearing on this date and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.NIRANJAN S.KUMAR, Advocate for the Petitioner and of MR.K.DINESH BABU, ADDITIONAL PUBLIC PROSECUTOR for the respondents No.1 & 2 and of MR.N.ANANTHA PADMANABHAN, for Respondent No.3, this Court made the following order:

(Order of this Court was made by M.SATHYANARAYANAN, J) Heard Mr.Niranjan S.Kumar, learned counsel appearing for the petitioner, Mr.K.Dinesh Babu, learned Additional Public Prosecutor appearing for the respondents 1 and 2 and Mr.N.Anantha Padmanabhan, learned counsel appearing for the third respondent. 1/3

2.The learned counsel appearing for the respondent would submit that on account of sudden cloud burst, the arrangements already made, could not be gone through and as per circular dated 07.08.2019, issued by S.B.O.A. Matriculation and Higher Secondary School, Madurai - 625 019, the minor daughter of the petitioner as well as the third respondent is having examination schedule from 16.08.2019 to 22.08.2019 and therefore, prays that the schedule for visitation may be fixed accordingly.

3.This Court heard the petitioner as well as the third respondent, who remain present before this Court. 4.In the light of the above, the third respondent is directed to bring the detenue viz., Narthana Nayanai before this Court on 22.08.2019 at 2.15 p.m., so as to enable this Court to pass appropriate orders as to the grant of visitation rights. 5.Call on 22.08.2019 at 2.15 p.m..
