Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to change the classification of the land and issue patta to the petitioner by way of concluded the 1st respondent's proceedings in K:K/vz;/ 27831/2020/o1 dated 07.06.2021.

ORDER

The writ petition is filed seeking a direction to the respondents to change the classification of the land and issue patta in the name of the petitioner in the light of the order passed by the 1st respondent dated 07.06.2021 in his proceedings in K:K/vz;/ 27831/2020/o1.

2. According to the petitioner, he purchased 1.65 acres of land in S.No.141/1 at Prakasapuram Village, Kodaikkanal Taluk, Dindigul District from one Saleth Mary and two others who are all legal heirs of one 2/6

Sengolraj. Based on the said sale deed, the petitioner submitted a representation before the 1st respondent seeking issuance of patta in his name after changing the classification of the land. The said representation of the petitioner dated 19.11.2020 was forwarded to the 2nd respondent by the 1st respondent on 07.06.2021 in his proceedings in K:K/vz;/ 27831/2020/o1. Thereafter, there is no progress in the matter. Therefore, the petitioner has come before this Court with the above mentioned prayer.

3. The learned Additional Government Advocate appearing for the respondents 1 to 4 would submit that the 2nd respondent will consider the representation of the petitioner dated 19.11.2020 and pass orders on its own merits within the time stipulated by this Court.

4. The learned counsel appearing for the respondents 5 to 7 would submit that the property was assigned in favour of one Vincent and his legal heirs. He would further submit that the petitioner claims right under the unregistered sale deed allegedly executed by the legal heirs of the said Vincent's brother. Therefore, the petitioner's request cannot be considered. 3/6

5. The representation submitted by the petitioner dated 19.11.2020 was already forwarded by the 1st respondent to the 2nd respondent for enquiry. Therefore, without expressing any opinion on the rival claimants made by the respective parties, this Court in inclined to direct the 2nd respondent to consider the representation of the petitioner dated 19.11.2020, forwarded by the 1st respondent and pass final orders on its own merits and in accordance with law within a period of twelve (12) weeks from the date of receipt of a copy of this order. The 2nd respondent shall afford reasonable opportunity to the petitioner and the private respondents 5 to 7, before passing final orders.

6. With these directions, the writ petition stands disposed of. No costs.
