ORDER

The petitioner, who is facing a charge in C.C.No. 310 of 2019 on the file of the learned District Munsif cum Judicial Magistrate, Thiruvidaimaruthur, Thanjavur District, for the offence under Section 294(b), 323, 324, 506(ii), 307, 392 IPC altered into Section 294(b), 323, 324 and 506(ii) IPC, has filed this petition to quas the charge sheet.

2. The case of the prosecution is that due to previous enmity, the petitioner along with other accused abused the defacto complainant in filthy language, assaulted him with hands and also threatened him with dire consequences. Hence, the case.

3. The learned counsel appearing for the petitioner submits that the petitioner has amicably solved the issue with the defacto complainant and the defacto complainant is ready to compound the offence as against the petitioner.

4. However, considering the nature of offence, this Court is not inclined to accept the compromise memo entered into between the parties for quashing the charge sheet in C.C.No.310 of 2019 pending as against the petitioner.

5. Therefore, this Criminal Original Petition is dismissed. The petitioner can work out his remedy before the District Munsif cum Judicial Magistrate Court, Thiruvidaimaruthur, Thanjavur District, in the manner known to law.
