The petitioner is before this Court for disposal of the representation dated 28.04.2018 made by him to the respondent.
2. The petitioner's father was a Freedom Fighter and he was assigned some lands by the Government. Even though assignment was made, patta was not issued. Therefore, the petitioner seeks a direction to the respondent to dispose of the representation and to assign patta.
3. This Court, by its order dated 27.09.2006 in W.P.(MD) No.8591 of 2006, directed the respondent to pass orders within stipulated time. However, it appears that the assigned lands were taken over by the Government and alternate land was assigned. Even for that lands, patta is not issued.
4. Now that the petitioner, who is the son of the Freedom Fighter, made a representation on 28.04.2018 for issuance of patta, which is still pending on the file of the respondent. The respondent, by his letter dated 18.05.2018, has directed the Tahsildar to submit a report with respect to the land in Survey No.395/2A Kanvelipatti Village, Vadipatti Taluk, Madurai District. https://hcservices.ecourts.gov.in/hcservices/
5.Heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing for the respondent.
6. Considering the fact that the land was assigned in the year 1999 to the petitioner's father, who was the Freedom Fighter and the petitioner is also aged about 80 years, a direction is issued to the respondent to consider the representation of the petitioner dated 28.04.2018 and pass orders on merits and in accordance with law within a period of one month from the date of receipt of a copy of this order.
7. With the above direction, this writ petition is disposed of. No costs.
