O R D E R

(Order of this Court was made by S.TAMILVANAN,J.) The Writ petition has been filed under Article 226 of the Constitution of India, seeking an order in the nature of Writ of Mandamus, directing the respondent to consider the petition dated 25.08.2010 given by the petitioner, seeking community certificate to him and his family members, stating that he belongs to Malai Vedan community of Scheduled Tribe.

2.Heard the learned counsel appearing for the petitioner as well as the learned Special Government Pleader appearing for the respondent. 3.Learned Special Government Pleader appearing for the respondent has not disputed the fact that the petitioner is entitled to get community certificate stating that he belongs to Hindu Malai Vedan community of Scheduled Tribe, if it is possible to establish his claim as per procedure known to law.

4.On the aforesaid facts and circumstances, we find it just and reasonable to dispose of the Writ petition, directing the respondent to consider the representation of the petitioner dated 25.08.2010 and pass appropriate orders according to law.

5.Learned Special Government Pleader appearing for the respondent further submitted that since the petition is dated 25.08.2010, the same may not be available with the respondent, hence, he may be permitted to furnish a copy of the same to the respondent. https://hcservices.ecourts.gov.in/hcservices/

6.In the result, the respondent is directed to consider the representation of the the petitioner dated 25.08.2010 and pass appropriate orders after making enquiry within a period of six weeks. If the representation is not available the petitioner herein shall furnish a copy of a fresh representation within two weeks. Thereafter, within 6 weeks appropriate order shall be passed by the respondent according to law.
