Prayer: Writ Petition filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the respondents to remove the encroachment made by the fifth respondent herein by constructing Ration Shop in land of Waterbody, namely, Muthoorani situated in Survey No. 248/1, Ward No.22 (Old Ward No.7), Karaikudi Municipality, Sivagangai District by considering the petitioner's representation, dated 28.03.2023. ORDER

Heard the learned counsel on either side.

2. The grievance of the petitioner is that in the petition mentioned water body a ration shop is being put up.

3. When the matter was taken up for final hearing today, the learned Standing Counsel appearing for the local body clarified that decision has been taken not to put up any construction in the petition mentioned water body and 2/4

that ration shop will be put up only in some other site. It has been further undertaken that the water body will be restored to the original condition.

4. Recording the said undertaking, this writ petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
