For Respondent : Mr.K.Sanjai Gandhi, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.67 of 2021 on the file of the respondent police.
ORDER : The Court made the following order :- The petitioner/A1, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 379, 353 of IPC and Section 21(1) of Mines and Minerals (Development and Regulation) Act, in Crime No.67 of 2021 on the file of the respondent police, seeks anticipatory bail.
2.The case of the prosecution is that the petitioner said to have illegally transported two unit of sand by using Tipper Lorries with the help of JCB. Hence, the complaint.
3.The learned counsel for the petitioner submitted that the petitioner has not committed any offence as alleged in the First Information Report. He would further submit that the petitioner is ready to abide by any conditions.

4.The learned Government Advocate(Crl.Side) appearing for the respondent police strongly opposed this petition on the ground that there are three previous cases pending against the petitioner and the offences are serious in nature. He further submitted that the petitioner has illegally transported two units of sand.
5. Considering the facts and circumstances of the case and also considering the fact that there are three previous cases pending against the petitioner and the offences are serious in nature and hence, this Court is not inclined to grant anticipatory bail to the petitioner.
