PRAYER: Petition is filed under Section 482 of Criminal Procedure Code to call for the records in proceedings in summons issued by the second respondent, dated 09.05.2021 and quash the same in respect of the petitioners concerned.

ORDER

This petition is filed seeking to quash the summons issued by the second respondent, dated 09.05.2021 in respect of the petitioners concerned.

2.When the matter was taken up for hearing on 28.06.2021, the matter was referred to mediation and Mr.Aruljoseph, which was appointed as Mediator and later, it appears that the learned counsel for the third respondent died and the third respondent has also not appeared before the Mediator.

3.Today, when the matter is taken up for hearing, the learned Additional Public Prosecutor would submit that based upon the complaint given by the husband, enquiry was undertaken and it was closed before the second respondent police in CSR No.133 of 2021, dated 24.06.2021.

Crl.O.P.(MD)No.6969 of 2021 3.Since the complaint has been closed, the petition has become infructuous.

4.Recording the submission made by the learned Additional Public Prosecutor, this Criminal Original Petition is dismissed as infructuous. Consequently, connected miscellaneous petition is closed.
