RESPONDENTS/RESPONDENTS Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to condone the delay of 558 days in representing the appeal in CMA(MD) SR No.36582 of 2018 filed against the judgment and decree DT 17-11-2017 in MCOP.No.43 of 2014 on the file of the Subordinate Judge of Ramanathapuram.

ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.V.SAKTHIVEL, Advocate for the petitioner, the court made the following order:- This petition is filed to condone the delay of 558 days in representing the papers in C.M.A.(MD)No.SR36582 of 2018. 2.Heard learned Counsel appearing for the petitioner. 3.This Court is convinced with the reasons stated in the affidavit filed in support of this petition. Though the petitioner has given explanation for the delay, the delay could have been avoided, if due diligence is shown by the petitioner. Hence, this Court is inclined to allow this petition on terms. Accordingly, this petition is allowed and the delay is condoned on condition that the petitioner pay a sum of Rs.2,000/- to the credit of "Sidha Clinic" attached to this Bench, within a period of two weeks from the date of receipt of a copy of this order.
