Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the respondent to remove the Seemai Karuvelam tree in Mennamelkudi Kanmai in Survey No.1 in Menmalkidi Village, Perumarudhur Taluk, Pudukkottai District.

ORDER

[Order of the Court was made by A.SELVAM, J.] This writ petition has been filed under Article 226 of the Constitution of India praying to direct the respondents to remove Seemai Karuvelam trees from Minnamozhi Kanmai, Manamelkudi Taluk, Pudukkottai District, by way of issuing a writ of mandamus. https://hcservices.ecourts.gov.in/hcservices/

2.It is averred in the petition that the petitioner is a resident of Perumarudhur Village, Manamelkudi Taluk, Pudukkottai District. Further it is averred in the petition that in Minnamozhi Kanmai so many Seemai Karuvelam trees are in existence. Under the said circumstances the petitioner has given a representation to remove the same. But the authorities have not taken any steps and therefore the present writ petition has been filed for getting the relief sought therein.

3.Considering the nature of the relief sought in the writ petition and also considering the fact that already representation has been given to the authorities and no action has been taken, this Court is of the view to pass the following order. 4.In fine, this writ petition is allowed without costs and the respondents are strictly directed to remove Seemai Karuvelam trees from Minnamozhi Kanmai, Manamelkudi Taluk, Pudukkottai District within a period of four months.
