RESPONDENT / COMPLAINANT For Petitioners : MR.D.VENKATESH Advocate For Respondent : MR.A.ROBINSON, Govt. Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners, who are arrayed as accused Nos.1 and 3, apprehending arrest at the hands of the respondent police for the offences punishable under Sections 420, 341, 294(b) and 506(ii) IPC in Crime No.197 of 2018, on the file of the respondent police, seek anticipatory bail.

2.The learned counsel for the petitioners submits that the petitioners are innocent persons and that the petitioners have not committed any offence as alleged by the prosecution and prays for anticipatory bail in favour of the petitioners. He further submitted that the amount involved in this case is Rs.5 lakhs. The petitioners are ready to pay a sum of Rs.1 lakh.

4. Heard the learned Government Advocate (Crl.side) appearing for the State.

5.The petitioners shall deposit a sum of Rs.1 lakh to the credit of Crime No.197 of 2018 on the file of the learned Judicial Magistrate, Nanguneri. The respondent police is also directed to intimate the defacto complainant, who is entitled to withdraw the same. Taking into consideration of the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioners, with certain conditions. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on https://hcservices.ecourts.gov.in/hcservices/

their appearance before the learned Judicial Magistrate, Nanguneri, and on her executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously. 6.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy is made ready, failing which, the petition for anticipatory bail shall stand dismissed.
