DECREE: This Appeal coming on for hearing on this day, Upon perusing the grounds of Appeal, the Judgment and Decree of the Appellate Court and that of the court of first instance and the material papers in the Appeal, and upon hearing the arguments of Mr.N.Dilip Kumar, Advocate for the Appellant and of Mr.J.Barathan, Advocate for the Respondent, and this Court, while dismissing the appeal, doth order and decree as follows:

(i)that the Judgment and Decree of the Principal District Judge, Virudhunagar at Srivilliputhur dated 30.08.2011 made in A.S.No.09 of 2010 partly modifying the judgment and decree dated 07.12.2009 made in O.s.No.19 of 2008 passed by the learned Subordinate Judge, Sivagangai, be and hereby are confirmed and the Second Appeal is dismissed and;
