Palaniappan v. The Executive Officer
BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT DATED: 04.11.2015
CORAM:
THE HON'BLE MR.JUSTICE K.RAVICHANDRABAABU W.P.(MD)No.20000 of 2015 Palaniappan .. Petitioner Vs.
The Executive Officer Keeranur Selection Grade Panchayat Keeranur Pudukottai District.
.. Respondent Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing the respondent to consider the Petitioner's representation dated 26.10.2015. For Petitioner :
Mr.D.Rameshkumar For Respondent : Mr.M.Rajarajan Government Advocate
O R D E R
The petitioner seeks for a direction to the respondent to consider his representation dated 26.10.2015, whereby he made some objections for providing water supply to the neighbour street. 2.First of all, having given the representation only on 26.10.2015 and filing a writ petition on 03.11.2015, seeking for disposal of such representation cannot be justified. If a representation is made to an authority, the person who gave such representation has to give sufficient and reasonable time for the authority to consider and act on such representation. Therefore, this sort of filing writ petition within few days of making the representation, cannot be entertained by this Court. Therefore, I find that the present writ petition is highly premature. Consequently, this writ petition is dismissed. However, liberty is given to the petitioner to approach this Court if his representation has not been considered within reasonable time.
